TERMS AND LIABILITY WAIVER FOR RAD GLUE
CAUTION: READ CAREFULLY BEFORE PURCHASING OR USING RAD GLUE. THIS
AGREEMENT LIMITS THE LIABILITY OF TONY’S RADIATOR GLUE LTD.
By purchasing, using, or handling Rad Glue, a two-part epoxy product sold by Tony’s
Radiator Glue Ltd. (the ”Company”), you (”User”) agree to be bound by these Terms
and Liability Waiver (”Terms”). If you do not agree, do not purchase or use Rad Glue.
1. Risks of Use
Rad Glue is a chemical epoxy intended for radiator, oil cooler, air conditioning, and
charge air cooler repairs. Use may result in risks, including but not limited to:
• Body irritation (e.g., skin, eye, or respiratory irritation from contact or inhalation
of fumes).
• Repair failure (e.g., leaks or improper bonding) if misapplied, potentially causing property damage (e.g., vehicle engine damage) or personal injury.
• Environmental hazards if not disposed of properly per local regulations.
2. User Responsibility
• Users must strictly follow all instructions provided with Rad Glue, including mixing ratios, curing times, surface preparation, and safety precautions.
• Users must consult the Material Safety Data Sheet (MSDS), available at www.radglue.com, for handling, storage, and disposal guidelines.
• Failure to follow instructions or MSDS constitutes misuse, voiding any liability
claims against the Company.
• Users are responsible for ensuring Rad Glue is suitable for their specific application and for conducting post-repair testing to verify performance.
3. Assumption of Risk
By using Rad Glue, User acknowledges and voluntarily assumes all risks associated
with its use, including but not limited to body irritation, repair failure, property damage, or financial loss, whether from proper use or misuse.
4. Waiver and Release of Liability
To the fullest extent permitted by law, User waives, releases, and discharges Tony’s
Radiator Glue Ltd., its officers, directors, employees, agents, and affiliates (collec1
tively, the ”Released Parties”), as well as the manufacturer of Rad Glue, from any and
all claims, demands, damages, losses, or liabilities (including personal injury, property damage, or economic loss) arising out of or related to the use or misuse of Rad
Glue, except in cases of gross negligence or willful misconduct by the Company.
5. Indemnification
User agrees to indemnify, defend, and hold harmless the Released Parties from any
claims, losses, damages, liabilities, or legal costs (including reasonable attorney fees)
arising from User’s use or misuse of Rad Glue, including third-party claims (e.g., damage to a customer’s vehicle).
6. No Warranty
Rad Glue is sold ”as is” without any warranties, express or implied, including but
not limited to warranties of merchantability, fitness for a particular purpose, or noninfringement. The Company, as a seller, does not guarantee the performance or
results of Rad Glue in any specific application.
7. Limitation of Liability
Tolias the Company’s total liability for any claim arising from Rad Glue shall not exceed the purchase price of the product. The Company is not liable for any indirect,
incidental, consequential, special, or punitive damages (e.g., engine damage, lost
profits, or business interruption), even if advised of the possibility of such damages.
8. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining
provisions shall remain in full force and effect.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of British Columbia, Canada, without regard
to conflict of law principles. Any disputes arising under these Terms shall be resolved
exclusively in the courts of British Columbia, and User consents to the jurisdiction of
such courts.
10. Entire Agreement
These Terms constitute the entire agreement between User and the Company regarding the use of Rad Glue and supersede any prior agreements or understandings,
whether written or oral.

11. Modifications
The Company reserves the right to modify these Terms at any time. Updated Terms
will be posted at www.rad-glue.com, and continued use of Rad Glue constitutes acceptance of the modified Terms.

By purchasing or using Rad Glue, User confirms agreement to these Terms. If User
